Terms and Conditions of Business Enel X Way Germany GmbH

1 Scope

The following general terms and conditions apply to all deliveries between us and a customer in the version valid at the time of the order.

A customer is any natural person who concludes a legal transaction for purposes which are predominantly neither their commercial nor their independent professional activity (§ 13 BGB (civil code of Germany)).

2 Entering into a Contract, Storage of the Contract Text

The presentation of the goods in our online shop does not constitute a legally binding contract offer on our part, but is a non-binding invitation for the customer to order our products. By ordering the desired goods, the customer makes a binding offer to conclude a purchase contract.

Upon receipt of an order in our online shop, the following rules apply: the customer makes a binding contract offer by successfully going through the order procedure envisaged in our online shop.

The order is made in the following steps:

1) Selection of the desired products (e.g. charging stations)
2) Confirmation by clicking on the "Add to Basket" button
3) Checking the product details shopping cart (“View Cart” button)
4) Proceeding to the checkout (“Checkout” button)
5) Entering the name, telephone number and email address
6) Entering the shipping address and choosing the payment method
7) Binding submission of the order by clicking on the button "Place Order"

The customer can return to the website before entering the order by pressing the "back" button in the Internet browser used by him after checking his information, on which the information of the customer are recorded and correcting or correcting input errors. Close the internet browser to cancel the order process. We confirm the receipt of the order directly by an automatically generated email ("Order Confirmation"). This still does not represent acceptance. Your order is regarded as accepted when we have sent a Shipping Confirmation email. Where your offer is not accepted by us within 14 calendar days, the offer is regarded as rejected.

Online shop contract storage: we save the contract text and send you the order data by email. The contract is based on this general terms and conditions.

3 Prices, Shipping Costs, Payment Due Date

The indicated prices include the statutory sales tax and other price components. There may also be additional shipping costs listed.

The available payment options are: credit card (Visa, Mastercard), PayPal.

4 Delivery

Unless stated otherwise in the product description, all items offered by us are ready for immediate shipment. Shipping will be made latest within 3-5 working days after circulating with you the Shipping Confirmation email. The shipping starts on the working day after conclusion of the contract or after receipt of payment. If the shipment should arrive on a Saturday, Sunday or public holiday at the place of delivery, the shipment shall be made on the next working day.

The risk of accidental loss and accidental deterioration of the goods sold shall not pass to the buyer until the goods have been handed over to the buyer, even in the case of consignment purchase.

5 Retention of Title

All delivered goods remain our property until payment has been made in full.

6 Cancellation Clause

Customers are entitled to a right of withdrawal under the following conditions:

Right of Withdrawal

You have the right to withdraw this contract within fourteen calendar days without giving any reason. The cancellation period is fourteen calendar days from the date on which you or a third party named by you, who is not the carrier, has taken possession of the goods.

by means of a clear statement (e.g. a letter sent by post or email) about his decision to withdraw from this contract. The customer may use the attached model withdrawal form, which is not required.

Effects of Withdrawal

If you withdraw from this Agreement, all the payments received from you will be refunded, including the return shipping costs (except for the additional costs in case of a shipping method other than our preferred one - standard delivery), within fourteen days starting from the day the notification of your cancellation has been received by us. For this repayment, we use the same means of payment that you used in the original transaction, unless otherwise agreed with you. You will not be charged for the repayment fees. We can refuse the repayment until we have got the goods back. You must return the goods to us immediately and in any event not later than fourteen days from the date on which you inform us of the cancellation of this contract. We bear the standard cost of returning the goods.

8 Warranty

9 Contract Language

The language of the contract is English.

10 Applicable Law

It is only the law of the Federal Republic of Germany.
